Introduction

This website (www.combo.toys) (hereinafter the « site ») and all its pages are published and managed by Rebecca Cuglietta – Combo (hereinafter « Combo ») operating under the trade name « Combo », registered at the Crossroads Bank of Enterprises in Belgium under the number BE 0793 731 303, whose registered office is located at 45 Rue Emile Regard – 1180 Brussels – Belgium.

The present general terms and conditions of sale (hereinafter referred to as the « GTC ») are concluded between Combo, hereinafter referred to as « the Seller », and any natural or legal person wishing to make a purchase via the website of the Seller, hereinafter referred to as « the Buyer ».

Article 1: Purpose

The present General Terms and Conditions of Sale (GTCS) govern the sales of Products made through the Combo online store and form an integral part of the contract between the Buyer and the Seller. They are fully opposable to the Buyer who has accepted them before placing an order.

Any purchase of products appearing in the Combo online store supposes the prior consultation and full acceptance of these general conditions which can be consulted on the website. These conditions of sale will prevail over any other general or particular conditions not expressly agreed by the seller.

Combo reserves the right to modify its general terms and conditions of sale at any time by publishing a new version on the website. In this case, the general terms and conditions of sale applicable will be those in force at the date of payment of the order of the buyer.

Article 2 : Products and services

The products and services offered are those listed in the catalogue published on the site of the seller.

Each product or service is accompanied by a description as complete as possible established by the seller as an indication and is not contractual.

The photographs of the online store are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to the colors and accuracy of details of semi-handcrafted products. 

Combo cannot be held liable for any errors or omissions in this product presentation.

These products and services are offered within the limits of available stocks. If, in spite of our efforts, all or part of the articles are unavailable, we will inform the buyer by email as soon as possible and offers him/her the possibility to choose between waiting or cancelling without expenses the order of the unavailable articles. The available articles will be delivered normally.

The prices and taxes are specified on the site and are all taxes included (VAT and other applicable taxes).

Article 3 : Prices

The prices are indicated in euros (€), all taxes included, and do not take into account the possible expenses of delivery, which are invoiced in supplement before the validation of the order by the purchaser. The total amount (order and delivery costs) are indicated before the final validation of the order form.

In case of promotions and discounts, these will be automatically applied to the Buyer’s order, provided that the promotional code has been correctly entered and that the legal requirements as a Buyer have been met.

In case of withdrawal, the costs of returning the product(s) are at the expense of the Buyer (see Article 8 below).

The seller reserves the right to modify its prices at any time by publishing them online.

Article 4 : Geographical zones

The online sale of the Combo toys present on the site will be delivered in the following countries : Belgium, France, Spain, Italy, Portugal, Germany, The Netherlands, Austria, Norway, Finland, Great Britain and Switzerland.

The aim is to send Combo to other countries in the upcoming months. For international shipments, outside of these countries, please contact us at hello@combo.toys, we will be happy to organise the delivery accordingly.

Article 5 : Orders

To make a purchase, the Buyer will be asked to : 

-Fill in the contact form on which he will indicate all the details requested : email, first and last name, address of delivery and invoicing address. This step is needed to confirm and record the transaction.

-Fill in the online order form giving all the references of the chosen products;

-Validate the order after having checked it, the buyer will also have the possibility to identify possible errors made in the data entry during the ordering process and to correct them. The language proposed for the conclusion of the orders is English;

-Make the payment in the conditions provided: to make an order, the Buyer declares to be a natural person of at least 18 years and to have the legal capacity or to be holder of a parental authorization allowing him to make an order on the site.

-Confirm the order and payment: Confirmation of the order implies acceptance of these terms and conditions of sale, recognition of having full knowledge of them and waiver of its own conditions of purchase or other conditions.

When an order is placed, an acknowledgement of receipt of the order and a confirmation of payment of the order are sent to the email address provided by the buyer, so that s.he can keep her/his order and invoice.

The archiving of the purchase orders and invoices is carried out on a reliable and durable support which can be produced as proof.

Article 6 : Method of payment

The seller remains the owner of the ordered items until the full payment of the order by the Buyer.

The buyer makes the payment at the time of the final validation of the order using the chosen method of payment. This validation takes the place of a signature.

No banking information is kept on the server and Combo has no access to the bank details of the buyers.

The payment of the purchases can be done by :

-Credit card: the Combo online store allows secure payments by credit card, Visa, MasterCard, Maestro and Bancontact.

By communicating his banking information at the time of the sale, the Buyer authorizes the Seller to debit his card of the amount relating to the indicated price. The Buyer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it.

-Paypal: Paypal helps protect your credit card information with the best security and fraud prevention system on the market. When you use PayPal, your financial information will never be shared with the merchant. Combo takes care of the Paypal commission fee so that it is not charged to the buyer’s order.

In case of refusal of authorization of payment by credit card from the accredited organizations or in case of non-payment, the seller reserves the right to suspend or cancel the order and its delivery.

Article 7 : Delivery

Delivery costs are the responsibility of the Buyer, except in the case of promotional codes offering delivery costs.

Combo strives to keep the delivery fees as low as possible.
As a result, your carrier was chosen because it is the most affordable option to deliver to your location available to us.

The delivery fees are calculated directly through the carrier.

The delivery is carried out only after confirmation of the payment by the banking organization of the Salesman. 

The products are delivered to the address indicated by the Buyer on the online order form and only in the geographical areas mentioned in article 4 (Geographical areas). Additional costs resulting from incomplete or erroneous information provided by Buyer will be charged to Buyer.

a.      Delivery time

Upon receipt of the payment of the order, Combo will take the necessary steps to process and dispatch the ordered product(s) as soon as possible.

The delivery takes place, depending on the method chosen by the buyer, within the following time limits: – Standard delivery at home.

Belgium: 2-4 working days.
Europe : 5-6 working days.
Switzerland : 6-7 working days
UK : 6-7 working days

Delivery times may vary depending on the destination country chosen by the Buyer and the time of the order and are given as an indication only. No compensation can be claimed from the Seller or the carrier in case of late delivery. If the delivery time exceeds 30 days from the order, Combo will reimburse the Buyer. 

We are not responsible for the extension of the delivery time due to the carrier, especially in case of loss of the products, bad weather or strike.

b.       Verification of the order

All products leave our premises well packed and in perfect condition.

In the event that one or more of the products ordered are missing or damaged, the Buyer or the recipient must make the necessary reservations to the carrier at the time of delivery and immediately inform the Seller.

The verification is considered to have been carried out as soon as the Buyer or a person authorized by him, has received the order without expressing any reservations.

c.        Delivery error

In case of delivery error or non-conformity of the products with the indications on the order form, the Buyer shall inform the Seller within three (3) working days after receipt of the order by e-mail to hello@combo.toys mentioning the errors, accompanied by photos as proof. Combo will then confirm the non-conformity of the delivery with the order placed and will indicate the procedure to follow for the return of the goods.

The costs for the return of the goods will be charged to Combo only in the case of non-conformity.

Any claim not made in accordance with the rules defined above and within the time limits set shall not be taken into account and shall release the Seller from any liability towards the Buyer.

In case of error of delivery, the product(s) to be returned or exchanged for non-conformity will have to be sent back in its original packaging in perfect condition to : Combos srl, 45 rue Emile Regard 1180 Brussels – Belgium.

Article 8: Right of withdrawal: returns

In accordance with the law, the Buyer has the right to notify the Seller that s.he renounces her/his purchase, without penalty and without giving any reason, within 14 working days from the day after the delivery of the product or the conclusion of the service contract. This right of renunciation does not belong to the Professional Buyer or Retailers.

Within this period, the Buyer must notify his intention to renounce by e-mail to: hello@combo.toys and return, at her/his expense, the delivered product to the administrative headquarters of Combos srl, 45 rue Emile Regard 1180 Brussels – Belgium.

The return or the exchange of the product can only be accepted for the products as a whole, intact and in their original condition, in particular with a complete, intact packaging and in a saleable condition.

Incomplete, damaged or soiled goods will not be accepted for return or refund.

After acceptance of the return of the goods, the Seller undertakes to reimburse any payment, with the exception of the shipping costs, within fourteen (14) days.

Any retraction not carried out according to the rules and deadlines defined by the present article cannot be taken into account and will release the Seller from any responsibility towards the Buyer.

In case of non-receipt of the parcel by Combo, and without proof of its good delivery by the carrier, the product(s) will not be refunded or exchanged and Combo cannot be held responsible.

Article 9 : Guarantee

All products sold on the site « Combo.toys » benefit from the guarantee of conformity and the guarantee of defects provided by the law of September 1st, 2004 relating to the protection of the consumers in the event of sale of goods of consumption (article 1649 bis to 1649 octies of the Belgian Civil code).

This guarantee only covers defects of conformity existing at the time of delivery of the goods. Defects or damage due to the use of the Combo products other than for games, such as water damage, oxidation, heavy drop or shock, negligence and wear and tear, are not covered by the warranty.

The invoice or delivery note serves as a warranty certificate and must be retained by the Buyer. In case of a defect, the Buyer is obliged to inform Combo as soon as possible and at the latest within one week after the discovery of the defect.

Article 10 : Responsibility

The Seller, in the process of selling online, is only bound by an obligation of means: his/her responsibility cannot be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems.

The data on the site is given in good faith. The links proposed towards the sites of the manufacturers and/or the partners are given as information. The seller cannot be held responsible for the information coming from these sites.

Article 11 : Intellectual property

Combo is the owner of the website combo.toys and its contents. This includes all designs, texts, graphics, images and other contents of this Website in whatever format. The materials included in the website are protected by copyright. By using the Website you agree to respect the intellectual property rights of Combo.  Reproduction, copying, downloading, modification, transmission, republication or exploiting for commercial purposes any material contained within the Website are not allowed without the written permission from Combo. 

The photos have been taken entirely by us.

Article 12 : Personal data

All personal data necessary for the processing of an order are kept by the Seller or its employees and may be transmitted to companies with which the Seller – or its suppliers – collaborates, when such communication is necessary for the processing of the order.

The Buyer also authorizes the Seller to use this data to compile statistics in order to improve its site and the goods and services it offers.

Finally, the Seller keeps the personal data to facilitate future orders. The Seller undertakes not to disclose the information s.he has to any other companý or business.

You are likely to receive emails from our service, especially in the context of newsletters. You are free to unsubscribe at any time by contacting us at hello@combo.toys or on the link provided for this purpose in each of the emails sent to you.

You can at any time make a request to Combo – hello@combo.toys – to know what information about you is held by Combo. In accordance with the law of December 8, 1992 relating to the protection of the private life, the Buyer has a right of access, of correction, opposition and cancellation of the personal data concerning it near Combo.

Article 13 : Proof

The parties accept, within the framework of their relations, the electronic means of proof (as an example: email, computer backups, …).

Article 14 : Force majeure

The execution of the obligations of the Seller under the present contract is suspended in the event of a fortuitous event or force majeure that would prevent its execution. The Seller shall notify the Buyer of the occurrence of such an event as soon as possible.

Article 15 : Settlement of disputes

The present online sales conditions are subject to Belgian law. In the event of a dispute, the courts of the Seller’s registered office shall have jurisdiction, except in the case of binding public policy provisions.
